Performance Laboratory terms

A clear basis for using the Laboratory.

About this service

These Terms govern authorised access to the Science in Performance Performance Laboratory, a private digital performance-analysis service operated by Christopher Fennell trading as Science in Performance in England and Wales. Access is provided only to authorised athletes and authorised Science in Performance personnel.

1. Scope

The Performance Laboratory forms part of authorised Science in Performance coaching and performance services. It provides tools for performance testing, physiological analysis, calculations, longitudinal review, connected-device data and coach feedback.

2. Eligibility and access

Access is limited to users who have been issued valid credentials or an invitation/access code by Science in Performance. Athlete registration is invitation-only. There is no public coach-registration route.

3. Account security

You must keep your password, access code and account secure, must not share credentials, and must notify Science in Performance if you reasonably believe your account has been compromised. Science in Performance will not ask for your password in order to view your athlete record.

4. Permitted use

The Laboratory is for your own authorised performance monitoring, testing and coaching use. You must not attempt to access another athlete's information, share accounts, interfere with the service, circumvent security controls, use the service maliciously or reverse engineer protected software except where applicable law permits that activity.

5. Performance calculations and models

Calculations, predictions, zones and models are performance-analysis tools. Results depend on the quality of input data, test execution, model selection, measurement error and normal physiological variability. The Laboratory distinguishes measured, calculated, modelled, estimated and predicted outputs. Predicted values are not guarantees of future performance.

6. Health and medical limitation

The Performance Laboratory is intended for sports-performance and coaching purposes. It is not a substitute for medical diagnosis, medical treatment or emergency care. If you have symptoms, injury, illness or another health concern requiring clinical assessment, seek appropriate medical advice. Nothing in these Terms excludes responsibilities or rights that cannot lawfully be excluded.

7. Testing

Maximal and submaximal exercise testing can be physically demanding. Follow the stated protocol and appropriate safety guidance. Stop a test where clinically appropriate, including if serious or unusual symptoms occur, and seek appropriate medical assessment where indicated. Do not continue a protocol simply to obtain a result if it would be unsafe to do so.

8. Connected devices

Compatibility varies by browser, device and hardware. Sensor data may contain measurement error or drop-outs. Browser-based Bluetooth support depends on the user's device and browser. Direct ANT+ browser support is not guaranteed and may require a compatible bridge or third-party integration. Science in Performance cannot guarantee compatibility with every sensor or device.

9. Data accuracy and corrections

You are responsible for checking manually entered information. Genuine errors may be corrected through the Laboratory or coach review process. Where appropriate, corrections retain an audit trail rather than silently rewriting historical source data.

10. Intellectual property

Science in Performance branding, software, interface design, proprietary educational content, testing materials, graphics and written content are protected by applicable intellectual-property rights. Athlete-owned raw data do not become the property of Science in Performance merely because they are stored within the Laboratory.

11. Availability

Reasonable steps are taken to provide a reliable service, but uninterrupted or error-free availability cannot be guaranteed. Maintenance, third-party outages, device limitations and security measures may temporarily affect availability.

12. Suspension

Access may be suspended where reasonably necessary for security, suspected unauthorised use, account compromise, or expiry/termination of authorised access where contractually appropriate. Suspension does not automatically delete historical athlete records.

13. Account closure

When authorised coaching or Laboratory access ends, login access may be restricted or closed. Records, exports, retention and deletion will be handled in accordance with applicable law, the Performance Laboratory Privacy Notice and documented retention requirements. Where a deletion request is made, some information may still need to be retained where there is a lawful basis or legal requirement.

14. Liability and consumer rights

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits mandatory consumer rights. Any final limitation-of-liability wording must be interpreted in accordance with applicable England and Wales law and mandatory consumer protections.

15. Privacy

Use of personal information is described in the Performance Laboratory Privacy Notice. Accepting these Terms is not treated as a blanket data-protection consent for every processing purpose.

16. Changes to these Terms

The Terms are version controlled. Material revisions may require renewed acceptance before continued access. Minor formatting changes do not necessarily require a new acceptance.

17. Governing law

These Terms are governed by the law of England and Wales, subject to any mandatory consumer protections and jurisdictional rights that apply to you.
