Terms of service

A clear basis for working together.

About these terms

These terms apply to coaching, physiological testing, strength and conditioning and related performance-support services supplied by Science In Performance, led by Dr Christopher Fennell. The specific service, price, start date and any individual arrangements confirmed in writing form part of the agreement. If an individual written agreement conflicts with these general terms, the individual agreement takes priority except where your statutory consumer rights prevail.

Starting a service

A website enquiry and initial consultation are not a booking or contract. A contract is made only when Science In Performance confirms in writing that your booking has been accepted and confirms the service, price, billing arrangements and start date. Information provided by the athlete must be accurate and sufficiently complete for the service requested. Science In Performance may decline work that falls outside its competence, capacity or appropriate professional scope.

Coaching scope

Coaching provides training prescription, performance analysis, education and decision support. It does not replace medical care, diagnosis, physiotherapy, emergency support or treatment by an appropriately regulated professional. Performance outcomes cannot be guaranteed because they depend on health, adherence, recovery, competition conditions and other factors beyond the coach’s control.

Athlete responsibilities

You are responsible for deciding whether you are fit to train or test, following safety instructions, using suitable equipment and environments, and promptly reporting pain, illness, injury, medication changes, pregnancy, unusual symptoms or other circumstances that may affect participation. Stop activity and seek appropriate medical help where symptoms or risk warrant it. Do not use the coaching channel for emergencies.

Monthly coaching subscriptions

The Private Performance Partnership, Performance Coaching Programme and Individual Performance Programme are all ongoing monthly subscriptions. They are delivered through TrainingPeaks Premium and continue from one monthly billing period to the next until cancelled in accordance with these terms.

There is no start-up fee or minimum subscription period. Review frequency, consultation access and communication standards depend on the selected programme. Direct communication is professional coaching support, not continuous or emergency availability. You are responsible for checking programme updates and providing timely, useful feedback.

Fees and monthly billing

The monthly price is the price displayed on the website and confirmed in writing when your booking is accepted. Coaching subscriptions are billed monthly in advance. Your written confirmation will identify the first payment date and subsequent monthly billing date. One-off testing and strength and conditioning services may have separate booking or rescheduling conditions confirmed before purchase.

Your statutory right to cancel

If you are a consumer and enter into a coaching subscription or other service contract online, by email, by telephone or by another distance-selling method, you generally have 14 days from the day after the contract is made to cancel without giving a reason. This right is provided by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including regulation 30.

To cancel, send a clear statement confirming your decision before the cancellation period ends. Email [email protected]. You may use the model cancellation form below, but you do not have to; any clear statement is sufficient under regulation 32.

If you cancel, payments covered by the cancellation will be refunded within 14 days after Science In Performance is informed, using the same payment method unless expressly agreed otherwise. This follows regulation 34 and is subject to the early-start provisions below and your statutory rights.

Starting within the 14-day period

Science In Performance will not begin supplying a service during the 14-day cancellation period unless you make a separate, express request to start early. This follows regulation 36.

I want Science In Performance to begin providing the service before my 14-day cancellation period ends. I understand that, if I cancel during this period, I must pay a proportionate amount for the service already supplied. I also understand that, if a one-off service is completed in full during this period, I will lose my right to cancel once that service has been completed.

If you request an early start and then cancel within 14 days, you must pay a proportionate amount for the service supplied before cancellation. Any remaining balance will be refunded. For a one-off service completed in full within the cancellation period, the right to cancel ends only where you expressly requested the early start and acknowledged that the right would be lost on full completion.

Cancelling a monthly subscription after 14 days

After the statutory cancellation period, every coaching programme continues as an ongoing monthly subscription. You may cancel at any time by emailing [email protected] before your next billing date.

Your subscription will continue until the end of the current paid billing period. No further monthly payment will be collected after cancellation takes effect. This does not remove any right to a refund or other remedy where services have not been supplied with reasonable care and skill or where another statutory right applies.

Model cancellation form

Use the online form to complete and email your cancellation notice directly to Science In Performance. The form follows the information required by Schedule 3 of the Consumer Contracts Regulations 2013.

You do not have to use the form. Any clear cancellation statement sent before the applicable deadline is sufficient.

Appointments and changes

Please give as much notice as possible when rescheduling. Late cancellation, non-attendance, venue costs or non-refundable third-party expenses may be chargeable where this was explained at booking. Science In Performance may reschedule where illness, facility availability, safety or circumstances outside reasonable control make delivery impractical.

Third-party platforms

TrainingPeaks and any scheduling, payment, laboratory or communication platforms operate under their own terms and privacy notices. Science In Performance is not responsible for interruptions, account restrictions or data loss caused solely by a third-party service, but will take reasonable steps to maintain service continuity where practical.

Intellectual property

Programmes, reports, methods and resources remain the intellectual property of Science In Performance or their respective owners. You receive a personal, non-transferable right to use material supplied for your own training and performance. It must not be resold, published, copied for others or used to coach third parties without written permission.

Liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, Science In Performance is not responsible for indirect or consequential loss, loss arising from ignored instructions or undisclosed information, or events outside reasonable control. Any liability will be considered under applicable UK law and the specific circumstances.

Ending the relationship

Either party may end an ongoing coaching subscription in accordance with the monthly cancellation section above. Science In Performance may suspend or end a service immediately where payment remains overdue, communication is abusive, safety information is withheld, instructions create an unacceptable risk, or continued work would be unlawful or professionally inappropriate.

Privacy, changes and governing law

Personal information is handled as described in the Privacy Policy. Material changes to these terms will be published here and, where relevant to an active service, communicated directly. These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales unless mandatory consumer law provides otherwise.
